Hereinafter referred to as "Restaurant Colette."

1. **Purchase Process & Formation of Agreement**

a. Online purchase processes begin when the customer makes a reservation and/or places products in the online shopping cart (e.g., a gift voucher). The agreement comes into effect once the customer has checked the box to accept these terms and conditions and then definitively confirms the order or reservation.

For reservations and orders not made via the website, Restaurant Colette will confirm the agreed arrangements via email to the customer as much as possible, with a reference to the applicable terms through a clickable link or attachment. The agreement comes into effect once Restaurant Colette has sent this confirmation to the customer.

b. Products or services purchased by the customer, whether online or not, are described in sufficient detail on the website to allow the customer to assess them correctly. If the customer is unsure about the content, characteristics, or price of the offer, the customer must inquire with Restaurant Colette before completing the purchase process.

2. **Reservation, Confirmation, Reminders & Waiting List**

a. Restaurant Colette reserves the right to accept or refuse reservations (e.g., if the request comes from a profile that appears fraudulent or from a customer with whom Restaurant Colette has a dispute). A reservation is only final once confirmed by Restaurant Colette to the customer and the deposit payment has been received, if applicable. Restaurant Colette will then remind the customer of the reservation via email and/or SMS to the address and/or phone number provided by the customer for this purpose.

b. If no tables are available in the restaurant on the desired date and time, the customer can optionally register a provisional reservation through the "Waiting List" on the website. To do so, the customer enters the requested personal data and payment card details, after which the customer receives a confirmation email. Through this email, the customer can confirm the provisional reservation. If the desired reservation becomes final, Restaurant Colette will contact the customer, and any deposit amount due will become payable.

c. The customer must reconfirm any reservation at least 7 days before arrival. For groups of 8 or more, this must be done at least 15 days before arrival, at which point the customer must also provide the menu choice (as displayed on the website) for the entire party. Failure to reconfirm a reservation in time will be considered a "cancellation" according to the provisions of Article 5.

d. The customer explicitly agrees that Restaurant Colette may send reminders via email to remind them of reservations made or if a deposit payment has not yet been received.

e. The successful delivery of confirmations and/or reminders via email by Restaurant Colette can never be 100% guaranteed due to technological reasons. Additionally, incorrect entry of contact details by the customer may prevent the sending/receiving of such messages. The non-receipt of a confirmation or reminder by the customer can never be used as grounds for terminating the agreement or as a valid cancellation. If the customer has not received a particular confirmation or reminder, the customer can always request Restaurant Colette to resend it.

3. **Price Display**

a. Prices communicated by Restaurant Colette to the customer and/or displayed on the website are always in euros and inclusive of VAT and statutory taxes, unless explicitly stated otherwise. Any temporary offers and promotions will be clearly and separately displayed.

b. Restaurant Colette takes great care in placing prices on the website. Unintentional errors in these prices do not bind Restaurant Colette as long as the remote purchase has not been finalized. The prices displayed in an order summary on the screen or an order confirmation via email apply.

c. All offers are valid while stocks last. Restaurant Colette is not liable for the availability of products or ingredients, especially as Restaurant Colette works with fresh ingredients, whose availability depends on daily market supply. When products, ingredients, or menu options are unavailable, Restaurant Colette will propose an equivalent alternative to the customer.

d. Displayed prices are not necessarily all-inclusive. The customer may order additional consumables or options in the restaurant, which will be charged separately at market-conform prices.

e. For table menu choices, Restaurant Colette does its best to consider the preferences of each guest. If a menu is chosen with matching wines and not everyone at the table drinks alcohol, we will provide a suitable alternative. We also take into account allergies and pregnancy, provided this is communicated in time during the reservation or to the service staff. Such menu adjustments do not entitle the customer to a discount.

4. **Deposit for Groups of 8 or More**

a. The customer agrees that Restaurant Colette may request a deposit payment and may reasonably and at its discretion adjust the amount as necessary.

b. Restaurant Colette will confirm the amount and payment terms for the deposit to the customer. Restaurant Colette will also mention the final payment date, which may vary depending on the time of order or reservation. If the deposit is not received within the specified period, Restaurant Colette has the right to unilaterally dissolve the agreement without owing the customer any form of compensation. This explicitly includes the failure to successfully complete online payments within 30 minutes of purchase confirmation.

c. A deposit payment implies the irrevocable acceptance of the terms and the included cancellation policy by the customer.

d. Unless in the case of a valid invocation of the right of withdrawal or a valid cancellation, the customer pays the balance due on the day of their restaurant visit. The deposit already paid will be deducted from the total amount due on-site.

5. **Cancellation Policy & Changes to Reservations**

a. If the customer wishes to cancel or modify a (provisional or not) reservation, this must be done via the clickable link in the confirmation email received through the online reservation application OR via email OR by phone, after which Restaurant Colette will confirm the cancellation via email. Cancellations and requests to change reservations through other channels, such as SMS or social media, will not be accepted.

b. Whether and to what extent the customer is entitled to a refund of already paid deposits depends on the timing of the cancellation confirmation and the size of the expected party. Restaurant Colette charges a fixed cancellation fee per person, with the balance of the paid deposit amount minus this cancellation fee refundable to the customer:

For reservations of 2 to 7 people:
- Full release of pre-authorization if cancellation is more than 48 hours before the scheduled restaurant visit
- Cancellation fee of €50 per person if canceled within 48 hours
- Cancellation fee of €100 per person if canceled within 24 hours

For reservations of 8 or more:
- Full refund if canceled more than 30 calendar days before the scheduled restaurant visit
- 50% refund if canceled more than 15 calendar days before the scheduled restaurant visit
- The full deposit amount will be considered a cancellation fee if canceled within 15 calendar days before the scheduled restaurant visit.

In the event of a no-show, the customer owes a cancellation fee of €200 per person. If this amount exceeds the deposit already paid, Restaurant Colette will confirm the outstanding balance and payment terms to the customer via email.

c. The processing of cancellations/changes is only done during office hours (Monday to Friday: 9:00 a.m. - 5:00 p.m.) and not during holiday periods. The customer is asked to take this into account and report any cancellation or request for changes in time.

d. Refund of deposit amounts by Restaurant Colette to the customer in the context of cancellation is usually done via a gift voucher “Gift Voucher,” which the customer can use and apply to a future reservation, unless the parties expressly agree otherwise.

e. No interest is ever due on (re)payments of deposits.

f. Entering or providing payment details during (online) reservation automatically implies that the customer agrees to Restaurant Colette's cancellation policy and irrevocably authorizes the owed fees to be charged through the provided credit card, debit card, or through invoicing.

6. **Reflection Period & Right of Withdrawal**

a. The customer, acting as a natural person, has the right to withdraw from the purchase, without payment of a penalty and without stating a reason, within 14 calendar days from the day following the delivery of goods or the conclusion of the service agreement. If the agreement involves the delivery of goods, the customer must return the received goods to Restaurant Colette, with the direct costs and risks of return being borne by the customer.

b. The right to withdraw from the purchase does not apply to:

- Services whose execution has begun with the customer’s consent before the end of the reflection period
- Goods made according to the customer’s specifications or that have a personal character
- Goods that by nature cannot be returned
- Goods that can spoil or age quickly
This means the customer cannot invoke the right of withdrawal in the following cases:
- The customer makes a reservation or places an order as a Trader or for professional use
- The customer purchases a gift voucher that has already been used when the customer wishes to invoke their right of withdrawal
- The delivered goods contain food items
- The customer reserves services with execution within 14 calendar days

c. If the customer wishes to use the right of withdrawal, they must notify Restaurant Colette in writing in a timely manner. The customer can use the attached withdrawal form for this purpose, but it is not mandatory.
